Yes. Possession of Marijuana is still a crime in Toronto! The Toronto Police Services may exercise their discretion and either tolerate its use or seize marijuana without laying a criminal charge. However, it is still illegal, and the police may charge an individual with Possession of Marijuana contrary to the Controlled Drugs and Substances Act. Generally speaking, an individual who is charged and has no criminal record or earlier arrests for possession, will be dealt with leniently- the charge will be withdrawn upon the performance of community service or the payment of a charitable donation.
Be aware…..If you are a tourist or non-resident, the police may hold an individual charged for a bail hearing to ensure that they don’t disappear without dealing with the criminal charge.
