Assault with Intent to Resist Arrest

R. v. W.M., ONTARIO COURT OF JUSTICE, OLD CITY HALL, TORONTO:

The accused, W.M., was charged with assault with intent to resist arrest as a result of a police traffic stop in mississauga. The allegations against W.M., were that after the police attempted to arrest W.M., after his failing to identify himself pursuant to section 33(3) of the highway traffic act, W.M., pushed the arresting police officer in the chest and attempted to flee the scene.

The accused was arrested after a brief struggle and taken into police custody. Mr. Pyzer represented W.M., and was successful in having the charge against W.M., withdrawn.
